ARTICLE
VIII - ACCESSORY USES & BUILDINGS ARE REGULATED
REWRITTEN AS AMENDED BY ORDINANCES 413, 414,
423, 442, 443, 555, 557, 560, 569, 569A, 582, 583, 593, AND
594, AND AS ACCEPTED BY THE PLANNING COMMISSION ON SEPTEMBER
12, 1995 AND THE SUPERVISORS ON SEPTEMBER 14, 1995.
801 TERMS ARE DEFINED
801.01 ACCESSORY BUILDING means a part of the
main building, or a separate building devoted to an accessory
use and incidental to that of the principal building and is
located on the same lot as the principal building.
801.02 ACCESSORY USE means a use subordinate to
an incidental to the primary use of the main or principal building
or to the primary or principal use of the premises.
801.03 PRIVATE GARAGE means an accessory building
housing not more than four (4) vehicles owned and used by occupants
of the main building. Where more than four vehicles are housed
or where the vehicles are used by persons other than occupants,
the building is a STORAGE GARAGE. A private garage does not
need to be walled, A roofed but unwalled structure or CARPORT
is subject to the same regulations.
801.04 SIGN means a principal or accessory structure
or device that is arranged, intended, designed or used as an
advertisement, announcement, or direction; and includes a sign,
sign screen, billboard, poster panel and advertising, business
and identification devices of any kind.
* ADVERTISING means a sign which directs attention
to a business, commodity, service or entertainment, conducted,
or sold or offered only elsewhere than upon the premises where
the sign is displayed.
* BILLBOARD (Poster Panel) means a board, panel or tablet used
for the display of printed or painted advertising matter.
* BUSINESS SIGN - A sign which directs attention to a business,
profession or industry conducted, or to products sold, manufactured
or assembled upon the same premises upon which it is displayed.
(See Article II, USE REGULATIONS, Section 204, c for home occupation
sign).
* GROUND SIGN - A sign supported from the ground by a structure
or pole specifically designed to support the sign only.
* INDENTIFICATION SIGN - A sign used to display and identify
only the name of the individual, business, profession, organization,
or institution occupying the premises upon which it is displayed.
* NAME PLATE - is an identification sign in the form of a letterhead
plate indicating only the name or names of and profession of
the occupant of the premises.
* MARQUEE is a sign attached to or hung from a marquee, canopy
or other covered structure projecting from the supported by
the building and extending beyond the building wall, building
line or street lot line.
* NON-CONFORMING SIGN is a sign lawfully existing at the effective
date of the Zoning Ordinance which does not completely conform
to the sign regulations applicable in the Zoning District in
which it is located.
* OFFICIAL SIGN is a sign erected or placed by governmental
agency in furtherance of the public health, welfare, safety
and morals.
* POLE - (See Ground Sign)
* PROJECTING SIGN - A sign which is attached directly to the
building wall and which extends more than twelve (12) inches
from the face of the wall.
* TEMPORARY SIGN - A sign, banner or other advertising device
constructed of cloth, canvas, fabric, or other light temporary
material, with or without a structural frame, intended for a
limited period of display; including decorative displays for
holidays or public demonstrations.
* WALL SIGN - A sign which is painted on or attached directly
to the building wall and which extends not more than twelve
(12) inches from the face of the wall.
802 THE FOLLOWING ACCESSORY USES ARE PERMITTED:
802.01 In the R-1, R-2, and R-3 Districts
* - Private garages.
* - Home occupations.
* - Vegetable and flower gardens
* - Raising and keeping of domestic animals as pets, but not
on a commercial basis or on a scale objectionable to neighboring
property owners, and provided specifically that all horses,
pigs, cattle, poultry, sheep, goats, and similar farm animals
not be permitted in any event. (Z.A.- 8/28/81)
* -Tennis courts, swimming pools, garden houses, pergolas, ornamental
gates, barbecue ovens, fireplaces and similar uses customarily
accessory to residential uses.
* -Storage garages and parking lots for use solely by occupants
of the premises.
802.02 In the C-N District there may also be parking
lots providing they be paved.
802.03 In the C-T, I-L, I-H, and RR Districts
there may be any accessory use.
802.04 Temporary buildings for construction purposes
are permitted in any District As accessory buildings during
the course of construction.
802.05 Accessory buildings may not be used for
dwelling purposes.
803 ACCESSORY BUILDINGS MAY BE LOCATED IN ACCORDANCE
WITH THE FOLLOWING RULES:
803.01 Accessory buildings may be located in a
rear yard but may not occupy more than thirty (30) percent of
a rear yard.
803.02 Any accessory building closer than ten
(10) feet to a main building shall be considered as part of
the main building and shall be provided with the side and rear
yards required for the main building.
803.03 Where a garage is entered from an alley,
it shall not be less than ten (10) feet from the alley line.
804 SIGNS SHALL BE PERMITTED IN ACCORDANCE WITH
THE FOLLOWING REGULATIONS:
804.01 Churches, public and semi-public buildings,
hospitals and institutions in R District may have signs not
more than sixteen (16) square feet in area in a front yard.
804.02 In addition to the signs permitted in 804.01,
temporary signs not more than ten (10) square feet in area pertaining
to lease or sale of a premises, and name plates when non-illuminated
and no greater in area than two (2) square feet shall be permitted
in the R Districts.
804.03 In the C and I Districts signs of not more
than fifty (50) square feet are permitted and shall be erected
in such a manner as to be supported at, or in the rear of, the
front building or setback line and extend no more than ten (10)
feet forward of that line and no more than ten (10) feet above
grade at the building line, measuring from the the bottom of
the sign.
a. In addition, however, a billboard as here
before defined of not more than seventy- five (75) square feet
will be permitted in the C-N Districts; a billboard of not more
than three hundred (300) square feet will be permitted at the
C-T Districts; and, a billboard of not more than six hundred
(600) square feet will be permitted in the I-L and I-H Districts.
804.04 Any Sign Lighting shall be located and
arranged so as to avoid glare or direct projection onto a highway
or street, or into an adjacent residential area. All Sign Lighting
shall be non-flashing and non-moving, and in no way resemble
official traffic control devices.
804.05 For supporting Commercial Facilities located
in R-2 and R-3 Districts, in addition to the provisions set
forth in Section 804.01, 804.02, and 804.04 above, the following
regulations shall apply: (Z.A.- 11/09/88)
1. No sign shall be affixed to a pole or support
other than the primary structure on the property. There shall
be no detached signs. No sign shall be higher than the highest
part of the structure to which it is attached.
2. No sign shall be larger than thirty-two (32)
square feet in size.
3. No sign shall advertise anything other than
the name of the business located on the sign site, its address
and/or telephone number and the type of business conducted on
the site.
4. If the sign is lighted either directly or indirectly,
such lighting shall be operated only during the hours that the
business it advertises is open for operation.
805 FENCES SHALL BE LOCATED IN ACCORDANCE WITH
THE FOLLOWING RULES:
805.01 No fence or visual obstruction shall be
located within ten feet from the edge of that portion of any
street right-of-way extending thirty feet from an intersection,
which thirty feet shall be measured along the edge of the right-of-way.

805.02 Except as provided in Section 805.01, fences
less than six feet high may be erected on those parts of the
lot that are as far back as or farther back from the street
than the required front and side building lines.
