ARTICLE
II - USE REGULATIONS
REWRITTEN AS AMENDED BY ORDINANCES 413, 414,
423, 442, 443, 555, 557, 560, 569, 569A, 582, 583, 593, AND
594, AND AS ACCEPTED BY THE PLANNING COMMISSION ON SEPTEMBER
12, 1995 AND THE SUPERVISORS ON SEPTEMBER 14, 1995.

TERMS PERTAINING TO "USE"
ARE DEFINED * ACCESSORY BUILDING - A building
detached from the subordinate to the main building on
the same lot and used for purposes customarily incidental
to the main building.
* ACCESSORY USE - A use customarily incidental and subordinate
to the principal use of building and located on the same
lot with such principal use of building.
* AUTO BODY SHOP - Any structure or any building or part
thereof that is used for the repair or painting of bodies
and fenders of motor vehicles.
* BUILDING - A building is any structure intended for
the shelter, housing or enclosure of any person , animal
or property of any kind.
* BUILDING RESIDENTIAL - A residential building is a building
which is designed, used or intended to be used for human
occupancy. All residential buildings shall have permanent
foundations. (Z.A. - 8/28/81)
* BUILDING LINE (S) - Building lines are lines parallel
to and inside of the property lines within which buildings
may be constructed.
* DRIVE-IN - An establishment where food or beverage is
sold for consumption on the premises but not necessarily
within a building.
* DWELLING - See BUILDING, RESIDENTIAL.
* DWELLING, SINGLE-FAMILY - A Single-Family Dwelling is
a building and appurtenant structures designated for or
used exclusively for occupancy by one family, related
by blood, marriage or adoption, and non-paying guests.
* DWELLING, TWO-FAMILY - A Two-Family Dwelling is a building
that contains only two living units.
* DWELLING, MULTIPLE-FAMILY - A Multiple-Family Dwelling
is a building that contains more than two living units.
* FAMILY - A family is one or more persons occupying a
living unit as an individual housekeeping organization
as distinguished from a group occupying a boarding house,
lodging house, or hotel.
* FILLING STATION or SERVICE STATION - is any buildings,
structures, or premises, enclosure or other place used
for the dispensing, sale, or offering for sale of automobile
or truck fuel and oil at retail. When such dispensing,
sale or offering for sale of automobile fuel and oils
is incidental to the conduct of a motor vehicle repair
shop, the premises shall be classified as a motor vehicle
repair shop.
* GARAGE APARTMENT - A garage apartment is a living unit
for not more than one family erected above a garage, said
garage being accessory to the main building.
* HOME OCCUPATION - Any gainful occupation or profession
operated by a member of the immediate family residing
on the premises, and where the business or profession
is conducted wholly within the dwelling. No home occupation
shall occupy more than twenty-five percent of the floor
area nor more than four hundred square feet of the gross
floor area. Any home occupation that creates objectionable
noise, fumes, odor, dust, electrical interference or more
than normal residential traffic shall be prohibited.
* HOSPITAL - A hospital is a place for the diagnosis,
treatment, or other care of humans and having facilities
for inpatient care including such establishments as a
sanatarium, sanatorium, and preventorium.
* HOTEL - A building used as the temporary abiding place
for individuals who are, for compensation, lodged, with
or without meals and in which provision may be made for
cooking in any individual room or suite. A hotel may include
restaurants, newsstands, and other accessory services
primarily for serving its occupants and only incidentally
the public.
* APARTMENT HOTEL is a multiple dwelling under resident
supervision.
* INSTITUTION - An institution is a non-profit establishment
for public use.
* JUNKYARD - A junkyard is a lot, land, or structure,
or part thereof, used primarily for the collecting, storage,
or sale of waste-paper, rags, scrap metal, or discarded
material, or for the collecting, dismantling, storage,
or salvaging of machinery or vehicles not in running condition,
and for the sale of parts thereof.
* LIVING UNIT - A living unit is rooms which must include
a kitchen.
* LODGING HOUSE - A lodging house means a dwelling consisting
of not more than one living unit occupied by persons not
related by blood, marriage, or adoption. This term includes
ROOMING HOUSE, BOARDING HOUSE and NURSING HOME.
* MOBILE HOME - A mobile home is a detached single-family
dwelling unit with all of the following characteristics:
(a) designed for long-term occupancy and containing sleeping
accommodations, a flush toilet, a tub or shower bath,
and kitchen facilities, with plumbing and electrical connections
provided for attachment to outside systems; (b) designed
to be transported after fabrication on its own wheels
or on a flatbed or other trailers or detachable wheels;
? arriving at the site where it is to be occupied in not
more than three major sections, complete including major
appliances and furniture, and ready for occupancy except
for minor and incidental unpacking and assembly operations,
location on foundation supports, connection to utilities
and the like.
* MOBILE HOME PARK - A mobile home park is a site housing
two or more mobile homes.
* MOTEL - A building or group of buildings, whether detached
or in connected units, used as individual sleeping or
dwelling units, designed with separate entrances and designed
for year-round occupancy, primarily for transient automobile
travelers and providing for accessory off-street parking
facilities. The term "motel" includes buildings
designated as tourist courts, tourist cabins, motor lodges,
and similar terms.
* OFFICE BUILDING - An office building is a building designed
for or used as the office (s) of professional, commercial,
industrial, religious, public or semi-public persons or
organizations.
* THEATER - A theater is a building or part of a building
devoted to the showing of moving pictures or theatrical
productions on a commercial basis.
* TOURIST HOME - A tourist home is a dwelling in which
overnight accommodations are used by transient guests
for compensation.
* TRAVEL TRAILER - A travel trailer is a trailer constructed
to be towed on its own chassis, for temporary occupancy
as a action trailer, or for occasional transport personal
affects.
* USE - Use is the specific purpose for which land or
a building is designed, arranged, intended, or for which
it is or may be occupied or maintained. The term "permitted
use" or its equivalent shall not be deemed to include
any nonconforming use.
* WINDOW - An opening to the outside, other than a door,
which provides all or part of the required natural light,
natural ventilation or both, to an interior space.

IN THE CONSERVATION DISTRICT "C"
PREMISES SHALL BE USED FOR THE FOLLOWING PURPOSES
ONLY:
* a. Farms for the raising of crops and cattle and not
involving any retail or wholesale activities, except for
retail and wholesale of home grown products.
* b. Single-Family dwelling when in connection with farm
activity.
* c. Woodlands for conservation, watershed, open space
and slope control.
* d. Public parks and recreation area, public community
buildings and public utility structures except that generating
plants, railroad yards, and similar uses are not permitted.

* e. Hospitals, religious and philanthropic institutions,
provided however, that such uses shall be located on sites
of ten acres or more, that buildings shall not occupy
more than ten percent of the site area, and that buildings
be set back from all yard lines a distance of one foot
for each foot of building height in addition to the yard
requirements for that district. |

IN THE RURAL RESIDENTIAL DISTRICT "R-R"
PREMISES SHALL BE USED FOR THE FOLLOWING PURPOSES ONLY:
* a. Any use permitted and regulated in the Conservation
District "C".
* b. Surface mining of coal and clay provided that the
entire disturbed area is reclaimed, reshaped and revegetated
in accordance with applicable federal, state and local
laws and ordinances and regulations governing surface
mining. (Z.A. - 8/28/81)
* c. Single-Family as restricted by minimum lot areas
on Page VI.1.

IN THE RESIDENTIAL SINGLE-FAMILY DISTRICT "R-1"
PREMISES SHALL BE USED FOR THE FOLLOWING PURPOSES
ONLY:
* a. Single-Family dwellings.
* b. Home occupations provided that such occupation shall
be conducted solely by resident occupants in the main
building, that not more than the equivalent of twenty-five
percent of the residence shall be used for such purposes,
that no display of products made be visible from the street.
* c. A small occupation sign not over two (2) square feet
in area if fixed to wall of main building and further
provided that sign is used only with reference to the
premises upon which it is erected.
* d. Elementary schools, junior high schools, middle schools,
and high schools, public library and community buildings;
private schools with curriculum similar to public schools.
* e. Accessory uses to the above.
* f. Recreational facilities of a non-commercial or non-amusement
park nature.
* g. Religious Institutions, provided, however, that such
uses shall be located on the sites of ten (10) acres or
more, that buildings shall not occupy more than ten (10)
percent of the site area, and that buildings be set back
from all yard lines a distance of one (1) foot for each
foot of building height in addition to the yard requirement
for that district.

IN THE RESIDENTIAL MULTIPLE-FAMILY DISTRICT "R-2"
PREMISES SHALL BE USED FOR THE FOLLOWING PURPOSES ONLY:
* a. Any use permitted and regulated in the "R-1"
District.
* b. Multiple Dwellings.
* c. Garage apartments for not more than one family; provided
however, that the building be set back ten (10) feet from
all side and rear lot lines, and the lot contains at least
3,000 square feet.
* d. Lodging houses, dormitory and boarding houses, provided
that none shall carry on any merchandizing or commercial
activities beyond that normally associated with such uses.
* e. Clubs, lodges, fraternities, sororities, except those
in which the chief activity is a service customarily carried
on as a business.
* f. Supporting Commercial Facilities as defined herein;
provided, however, that the floor area for such facilities
shall not exceed 1,000 square feet. Hours of operation
of such facilities shall be restricted to be open to the
public no earlier than 8 a.m. and no later than 9 p.m.,
prevailing time, of each day of operation. (Z.A. - 11/09/88):
o The term Supporting Commercial Facility as used
herein shall include and be limited to (Z.A. - 11/09/88):
o 1. Personal service shops such as beauty shops,
barber shops and pet grooming shops.
o 2. Professional offices for physicians, dentists,
attorneys, accountants, chiropractors, psychologists
and small animal veterinarians.
o 3. Studios of artists and photographers.
o 4. Child day care centers.
o 5. Restaurants, cafes and coffee shops.
o 6. Dressmaking, tailoring, millinery, shoe repair
and similar trades.
o 7. Bakeries, laundries, dry cleaners, flower shops,
craft shops, gift shops and antique shops.
o 8. Neighborhood stores such as delicatessens, grocery
stores and drugstores.
o 9. Repair and service shops (but no sales) for bicycles,
home electrical appliances, televisions, radios, and
similar home use articles.
o Specifically excluded from the term Supporting Commercial
Facility as used in this section are the following
uses (Z.A. - 11/09/88):
o 1. Any use permitted in Section 209, Subsection
"c" through "mm" of this Ordinance
(District "I-L").
o 2. Any use permitted in Section 208, Subsection
"b" through "h" of this Ordinance
(District "C-T").
o 3. Commercial banks or financing companies, except
that an automatic teller machine or similar device
is permitted, but only if it is located on the premises
of a permitted facility.
o 4. Commercial recreational facilities.
o 5. Motor vehicle sales, repair and/or service facilities
o 6. Any other use which would substantially interfere
with the residential character of the district.

IN THE RESIDENTIAL MOBILE HOME DISTRICT "R-3"
PREMISES SHALL BE USED FOR THE FOLLOWING PURPOSES ONLY:
* a. Any use permitted and regulated in the "R-2"
District.

IN THE NEIGHBORHOOD COMMERCIAL DISTRICT "C-N"
PREMISES SHALL BE USED FOR THE FOLLOWING PURPOSES ONLY:
* a. Office buildings, provided that no goods, wares,
or merchandise shall be prepared on the premises.
* b. Personal service shops such as beauty shops and barber
shops.
* c. Studios of artists and photographers.
* d. Retail stores.
* e. Parking lots, provided that the parking area shall
be paved and used for passenger vehicle parking only and
in no case for sale of vehicles.
* f. Commercial schools.
* g. Commercial greenhouses and nurseries.
* h. Shops for repair and servicing of bicycles, electrical
radio and television appliances, keys, typewriters and
similar articles where no individual establishment provides
more than 2500 square feet of floor space.
* I. Sale of goods and products at retail but excluding
new and used car sales. (Z.A. - 12/06/76 & Z.A. -

* j. Theaters but not drive-in theaters.
* k. Commercial recreation facilities.
* l. Banks.
* m. Mortuary parlors.
* n. Dressmaking, millinery, tailoring, shoe repair and
similar trades, and bakeries, laundries and dry cleaning,
provided that no individual establishment provides more
than 2500 square feet of floor space.
* o. Animal hospitals.
* p. Restaurants.
* q. Laundromats (Z.A. - 08/28/81)
* r. Service stations and auto body shops. (Z.A. - 08/28/81)
* s. A single-family dwelling which is part of a building
used for purposes permitted in a Neighborhood Commercial
District, and which dwelling is occupied by the owners
of the commercial enterprises being conducted in such

IN THE TRAVELERS COMMERCIAL DISTRICT "C-T"
PREMISES SHALL BE USED FOR THE FOLLOWING PURPOSES ONLY:
* a. Any use permitted and regulated in the "C-N"
District.
* b. Drive-in restaurants and theaters.
* c. New and used car sales.
* d. Machinery equipment sales and service.
* e. Bus terminals.
* f. Apartment hotels, hotels and motels.
* g. Laundromats. (Z.A. - 08/28/81)
* h. A single-family dwelling which is part of a building
used for purposes permitted in a Traveler's Commercial
District, and which dwelling is occupied by the owners
of the commercial enterprises being conducted is such
building. (Z.A. - 11/13/81)
* Where a lot in the "C-T" District is to be
used for a use permitted in the "C-N" or "C-T"
Districts and is next to an "R-R" or "R"
District and is not separated from the "R-R"
or "R" District by streets (does not include
alleys), then a solid fence or solid screen planting,
at least six (6) feet high shall be provided along all
property lines adjoining the "R-R" or "R"
District.

IN THE LIGHT INDUSTRIAL DISTRICT "I-L"
PREMISES SHALL BE USED FOR THE FOLLOWING PURPOSES ONLY:
* a. Light industrial uses, provided that such occupied
for manufacturing purposes shall not be operated in such
a manner as to create excessive noise or vibration; excessive
smoke, dust, dirt or other form of air pollution; electrical
or other similar type disturbance; excessive glare; and
shall not be operated in such a manner as to create any
dangerous, injurious, noxious condition or fire, explosive
or other similar hazard or other nuisance, condition or
element adversely affecting the surrounding area. Any
light industrial operation shall be conducted within a
building, or shall be enclosed by a solid fence or screen
planting not less than six feet in height along boundary
line bordering a conservation, rural residential, single-family
residential, multi-family residential or R-3 district.
Junk yards, auto salvage and scrap yards are prohibited.

* b. Any use permitted and regulated in the "C-N"
or "C-T" Districts, except apartment hotels,
hotels and motels.
* c. Assembly plants.
* d. Bookbinderies.
* e. Bottled gas sales and/or service.
* f. Canneries, fruit and vegetable.
* g. Cellophane products manufacturing.
* h. Ceramic products manufacturing.
* I. Cold storage or refrigerating plants.
* j. Concrete mixing or batching plants.
* k. Confectionery manufacturing.
* l. Dairy products manufacturing.
* m. Electrical products manufacturing and assembly.
* n. Fiber products manufacturing.
* o. Roof products and manufacturing.
* p. Foundry, casting lightweight nonferrous metals.
* q. Furniture manufacturing.
* r. Garment manufacturing.
* s. Glass products manufacturing.
* t. Ironworks, ornamental (no foundry, drop hammer and
no punch presses over 20 tons capacity).
* u. Leather products manufacturing (previously prepared
leather).
* v. Millwork.
* w. Paint mixing and treatment.
* x. Petroleum products, bulk terminal.
* y. Paper products manufacturing (previously prepared
materials).
* z. Pharmaceutical manufacturing.
* aa. Plastic products manufacturing (previously prepared
materials).
* bb. Railroad freight terminals.
* cc. Sheet metal products manufacturing.
* dd. Sign manufacture.
* ee. Television and radio broadcasting transmitters.
* ff. Textile products manufacturing.
* gg. Tire retreading, recapping ro rebuilding.
* hh. Tool manufacturing (no drophammer or punch press
of over 20 tons).
* ii. Toy manufacturing.
* jj. Warehouse or storage buildings.
* kk. Well drilling services.
* ll. Wood products manufacturing (assembling and finishing).
